1. Introduction

Welcome to Eicher Pro Store (“Platform”), the official e-commerce platform developed and managed for Eicher Motors Limited (“Eicher”, “we”, “our”, or “us”) and its authorized partners.

This website is owned by Evolve Brands Pvt. Ltd.

These Terms of Use (“Terms”) govern your access to and use of the Platform, including all information, tools, and services made available to you as a buyer (“you”, “user”, or “customer”).

By accessing, registering, or purchasing through the Eicher Pro Store, you agree to be bound by these Terms. If you do not agree, please refrain from using the Platform.

2. Eligibility

By using this Platform, you represent that:

  • You are at least 18 years of age and legally competent to enter into a binding contract under applicable law.
  • You are accessing the Platform for legitimate purposes related to the purchase of products, and not for resale, redistribution, or any fraudulent activity.

Eicher reserves the right to deny access or terminate your account if the eligibility criteria are not met.

3. Account Registration

To place an order, users must create an account by providing accurate and complete details such as name, contact number, email address, and location.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Eicher shall not be liable for any unauthorized access, misuse, or activity carried out through your account.

4. Product Information and Pricing

All product descriptions, images, specifications, and prices are provided by authorized sellers and are subject to change without prior notice.

Eicher and its sellers make reasonable efforts to ensure accuracy but do not guarantee that product details, pricing, or availability will always be error-free.

In case of pricing errors or technical inaccuracies, Eicher reserves the right to cancel, modify, or correct an order before shipment.

5. Order Placement and Acceptance

  • Placing an order on the Platform constitutes an offer to purchase the selected products.
  • The order shall be deemed accepted only upon confirmation via email or SMS by the seller or Eicher’s authorized fulfillment partner.
  • Eicher reserves the right to cancel or reject any order due to reasons including, but not limited to, product unavailability, incorrect pricing, or non-serviceable delivery locations.

6. Payments

All payments must be made online through the secure payment gateway integrated into the Platform.
Eicher does not store or have access to your payment credentials.

Transactions are processed by authorized third-party payment partners in compliance with RBI and data security regulations.
Cash on Delivery (CoD) is currently not available on the Eicher Pro Store.

Evolve Brands Pvt. Ltd. is authorized to collect payments on behalf of Eicher

7. Shipping and Delivery

Orders are fulfilled by authorized sellers and logistics partners.
Delivery timelines vary based on product availability, shipping location, and courier serviceability.

8. Returns, Replacements, and Cancellations

Buyers may initiate returns or replacements in accordance with the applicable return policy displayed on the product page.
Requests must be raised within the stipulated period and will be subject to verification.

Eicher reserves the right to approve or reject return requests based on product condition, reason for return, and seller policy.

 

9. Use of the Platform

You agree to use the Platform for lawful purposes only and shall not:

  • Engage in fraudulent, misleading, or abusive conduct.
  • Copy, distribute, or exploit any part of the Platform or its content for commercial purposes.
  • Interfere with or disrupt the security or functionality of the Platform.
  • Upload or transmit viruses, malicious code, or unauthorized data.

Violation of these Terms may result in suspension or termination of your account without prior notice.

10. Intellectual Property

All content on the Eicher Pro Store, including logos, trademarks, product names, text, graphics, and software, is the property of Eicher Motors Limited or its licensors.
You are not permitted to use, reproduce, or distribute such materials without prior written consent from Eicher.

11. Limitation of Liability

Eicher Pro Store acts solely as a digital platform facilitating transactions between authorized sellers and buyers.
Eicher is not liable for:

  • Any direct or indirect damages arising from product quality, delivery delays, or seller performance.
  • Technical issues or service interruptions caused by third-party providers.

Your sole remedy in the event of dissatisfaction is to discontinue the use of the Platform.

12. Indemnification

You agree to indemnify and hold harmless Eicher Motors Limited, its affiliates, officers, and employees from and against any losses, damages, liabilities, or claims arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

13. Privacy and Data Protection

Your personal information is collected and processed in accordance with our Privacy Policy.
By using the Platform, you consent to such processing and confirm that all information provided by you is accurate and complete.

14. Suspension or Termination of Access

Eicher reserves the right to suspend, limit, or terminate your access to the Platform at any time if:

  • You breach these Terms; or
  • Your activity is deemed fraudulent, suspicious, or harmful to the integrity of the Platform.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India.

16. Amendments

Eicher Motors Limited reserves the right to modify or update these Terms at any time without prior notice.
Updated versions will be posted on the Platform and will take effect immediately upon publication.
